La Famille會員計劃條款及細則
La Famille會員計劃(下稱「LFMP」)由Time Colour ( Hong Kong ) Limited時色(香港)有限公司(下稱「TCHKL」)擁有及營運,並受以下條款及細則所約束。此計劃只適用於香港特別行政區的La Famille實體分店及網上商店。透過申請成為LFMP之會員,即表示閣下已閱讀本條款及細則,並接受及同意受其約束(包括其不時之修改)。閣下亦同意向TCHKL提供閣下的個人資料(「個人資料」根據香港法例第486章《個人資料(私隱)條例》的釋義)及同意TCHKL可根據其個人資料(私隱)政策聲明收集及使用閣下的個人資料。
定義
- 「會員卡」指會員在成功申請LFMP並升級至銀卡或金卡會員後,由TCHKL向閣下發出的會員卡,用以獲享相關獎賞優惠。除另有指明外,會員卡是指實體卡。
- 「會員」指所有會籍級別的La Famille會員,包括準會員﹑銀卡會員及金卡會員。
- 「升級積分」指根據閣下於La Famille旗下分店及網上商店淨值消費單據所獲得之積分。此積分之用途為調整會員之級別。所有會員均可賺取「升級積分」。
- 「獎賞積分」指根據閣下於La Famille旗下分店及網上商店淨值消費單據所獲得之積分。此積分之用途為兌換La Famille禮券。只限銀卡及金卡會員可賺取「獎賞積分」。
- 「有效期」是指會籍的生效日期或升級或降級或續會起計12個月。(如由會籍升級至銀卡會員生效日期為7月1日,則有效期至翌年6月30日止)。
- 「分店」指La Famille在香港經營的實體零售商舖。
- 「網上商店」指La Famille在香港經營之網上商舖(https://www.lafamillecake.com) 。
- 「消費」指會員於分店或網上商店購買任何產品, 但不包括La Famille禮券、包裝及送貨費。
1. 會籍申請 - 申請人必須年滿18歲。
- 免費申請成為LFMP準會員(下稱「準會員」)時,須出示淨值合共港幣200元、不多於3張在過去30日內由分店發出的有效單據。於網上商店單次購物消費滿港幣200元,亦可在購物後在分店完成表格後免費申請成為準會員。
- 為方便獲悉優惠及推廣活動資訊,在登記時,會員可能會被要求向La Famille補充或提供完整及準確的個人資料,包括但不限於姓名、手機號碼、電郵地址、生日資料及聯絡地址等。
- 遞交申請後,一旦發現資料不符或未能核實申請人的資料,La Famille將會取消有關之會員申請,並不會另行通知。
- 當會員晉升成為銀或金會籍後,La Famille職員將以電話及/或電郵方式核對申請人的資料,並根據該資料發放會員通訊、優惠及禮券。
- 成功申請會籍後,會員申請會籍之消費收據中的貨品或服務一旦因退款事宜,以致最終的消費金額低於申請會籍的指定交易金額,其會籍將會被終止和取消,並不會另行通知。
- 在法律許可的範圍內,因顧客或會員的遺漏、疏忽及/或未能向TCHKL提供其最新的資料,或因該等資料的準確性及完整性所引致的任何索償、要求、責任或訴訟,La Famille及TCHKL均不會承擔任何責任。
2. 會籍級別及有效期 - 準會員在過去12個月內如無任何消費記錄,會籍將自動失效,而卡內的「升級積分」及「獎賞積分」亦會被自動註銷。
- 銀卡及金卡會籍的有效期均為12個月。
- 銀卡及金卡會員每消費港幣10元會自動取得1分「升級積分」及1分「獎賞積分」。準會員則每消費港幣10元會只會自動取得1分「升級積分」,沒有「獎賞積分」。
- 準會員在任何連續12個月內累積達120分「升級積分」,將會被自動升級成為銀卡會員。凡於會籍有效期內累積達120分「升級積分」,其銀卡會籍將會被自動保留並順延12個月。相反,如會員的「升級積分」不足120分,其銀卡會籍將會被降級為準會員。
- 銀卡會員在12個月內累積達500分「升級積分」,將會被自動升級成為金卡會員。凡於會籍有效期內累積達500分「升級積分」,其金卡會籍將會被自動保留並順延12個月。相反,如會員的「升級積分」不足500分,其金卡會籍將會被降級為銀卡會員。
- 所有會籍在有效期屆滿時及所有升級、降級或續會後,「升級積分」將自動重設為零。
- 會籍升級/降級基於累積「升級積分」並由系統自動更新。符合升級資格或未能延續同級會籍的會員均由系統自動處理而不可自行選擇是否升級/降級。
3. 會籍使用及會員折扣 - 會員行使會員權利及有關會員之交易,包括但不限於會員折扣、累積「升級積分」、累積「獎賞積分」、兌換會員優惠等,均須出示會員卡以作系統記錄。
- 會員每次於網上商店成功登入後的消費均有資格賺取積分,但不會享有會員折扣。如欲獲取「升級積分」及「獎賞積分」,會員須於消費完成後(以下單日為準) 1個月內主動前往任何分店,並向La Famille職員出示有效的會員卡及電子單據以記錄相應積分。
- 每位會員所獲發的指定會員卡只供會員本人使用,不得轉讓他人使用,如發現有濫用或不正當使用的情況,TCHKL保留終止或暫停其會籍的權利。
- 會員折扣不適用於購買La Famille禮券、已折扣之產品、包裝、送貨費用及指定貨品。
- 如會員遺失或損壞並需補領會員卡,須繳付港幣100元手續費,有關費用將不可退還及不可賺取積分。
- 購買La Famille禮券、包裝及繳付送貨服務費均不獲享任何積分、不計算為累積消費。
- 會員須妥善保管及使用其會員卡,TCHKL恕不負責任何因被盜用或遺失會員卡而導致的損失。
4. 獎賞積分 - 銀卡及金卡會員凡於分店消費時出示會員卡,消費淨值每港幣10元,即可獲得1分「獎賞積分」。因應個別推廣活動,所獲得的獎賞積分會有所不同。
- 「獎賞積分」於每年6月及12月的積分結算日 (6月30日及12月31日的23:59分)會自動轉換成相應之「La Famille禮遇」,並以平郵方式在兩個星期內寄往會員卡申請表上填寫的地址,寄出的「La Famille禮遇」一律不設補發。LFMP的積分、獎賞、優惠及會員帳戶只屬於該會員擁有,不得轉移或轉讓予他人。
- 「獎賞積分」有效期為會籍生效日期起計的12個月,及後的積分則以年度計算。該年度內所累積的積分有效期至該年度末為止,期滿後將自動註銷 (年度內能更新/晉升至更高級別會籍者除外)。用作申請會籍之消費不適用於賺取「獎賞積分」,會員須在獲得會員卡後之消費方開始賺取積分。
- 所有積分以TCHKL之系統記錄為準。TCHKL恕不接納任何於交易後補領積分的要求,網上商店之銷售除外(見上文2)。
- 積分不能轉讓及分拆,不同會員卡內的積分亦不可合併使用。
- 所有已取消的交易或購物退款,因應該次消費而獲得的「獎賞積分」將會自動扣除,包括因指定推廣計劃而額外獲得之「獎賞積分」。
- 銀卡及金卡會員不能於情人節、母親節、平安夜及聖誕節等節日使用「摯愛禮遇」的優惠。
5. 一般條款 - TCHKL會透過電郵或手機短訊向會員發送會員優惠及推廣的通知。會員須提供正確的電郵地址及手機號碼,以免錯失重要通知。
- 因任何電腦技術或系統問題而造成的積分損失,TCHKL恕不負責。
- TCHKL有絕對的酌情權以任何理由拒絕及/或撤銷任何申請者的會籍申請,及終止及/或取消其會籍。若會籍因任何原因被TCHKL終止,所有相關積分亦會被立即註銷。
- 如法院裁定本條款及細則內任何條款無效或不可強制執行,其餘條款將不受上述無效或不可強制執行影響,並將繼續具十足效力及作用。
- 本條款及細則受香港特別行政區的法律管限,而會員均同意受香港法院的專有審判權所限。
- TCHKL保留隨時在不另行通知的情況下修改本條款及細則的權利。
- 如有任何爭議,TCHKL保留最終決定權。
- 如中文版本與英文版本有任何差異,應以英文版本為準。
個人資料收集聲明 Personal Information Collection Statement
- TCHKL致力保護閣下的個人資料(下稱「個人資料」)。此個人資料收集聲明是依從香港特別行政區之《個人資料(私隱)條例》之要求,於向閣下收集個人資料時或之前通知閣下若干事項。TCHKL所收集及使用的個人資料只限用於TCHKL業務所需及向閣下提供最高服務質素的範圍內。
- TCHKL收集的會員個人資料可能會被用於會員帳戶及記錄的行政管理、廣告宣傳、市場營銷、向會員提供新聞及資訊、身份識別、服務、福利、優惠、促銷或資料及數據庫的行政管理;以及與前述相關的或衍生的一切其他用途。
- TCHKL可能提供及/或分享個人資料予TCHKL的第三方服務供應商、代理及承包商為TCHKL作上述用途。TCHKL亦可能基於以下情況透露個人資料:法律所需,法庭命令,政府或執法機構所需或懇切相信因保障TCHKL或其他人仕的權利或資產而有必要或被建議透露個人資料。
- 個人資料的提供完全是自願性質。然而,如閣下選擇不向TCHKL提供個人資料,則TCHKL可能無法為閣下提供有關的資訊或服務,或處理閣下的要求。
- 申請人有權查閱及更正與閣下有關的個人資料。若個人資料有所變更,請以書面聯絡本公司作出更新。
Terms and Conditions of La Famille Membership Program
La Famille Membership Program (“LFMP”) is operated by Time Colour (Hong Kong) Limited (“TCHKL”) and is governed by the following Terms and Conditions. The Program shall only be valid at physical La Famille stores / the eShop within the Hong Kong SAR. By applying for LFMP, you agree that you have read and understood these Terms and Conditions and agree to be bounded by the terms herein and as may be amended from time to time; you further agree to provide with TCHKL your personal data (“Personal Data”, as defined in the Personal Data (Privacy) Ordinance (Cap.486) of Hong Kong), and agree that TCHKL may collect and use your Personal Data in accordance with the Privacy Policy Statement.
Definitions
- “Membership Card” means the card issued to you to enjoy benefits upon successful registration of LFMP and upgrade to silver membership or gold membership. Unless otherwise specified, it refers to physical card.
- “Member” means a member of LFMP, including standard membership, silver membership, and gold membership.
- “Upgrade Points” means the points awarded to you based on the net purchase at La Famille stores and eShop. It serves as the purpose of membership gradings adjustment. Upgrade Points can be earned by all membership tiers.
- “Loyalty Points” means the points awarded to you based on the net purchase at La Famille stores and eShop. It serves as the purpose of La Famille coupon redemption. Loyalty Points are only valid to silver membership and gold membership.
- “Effective Period” means the 12 months following the membership effective date or upgrade date or downgrade date or renewal date. (i.e. if the effective date of standard membership upgraded to silver membership is 1 July, the expiry date will be 30 June the following year.)
- “Stores” means physical retail outlets operated by La Famille in Hong Kong.
- “eShop” means the online retail outlet (https://www.lafamillecake.com) operated by La Famille in Hong Kong.
- “Purchase” means any merchandise bought by member at La Famille stores or eShop, excluding La Famille coupons, wrapping service charges, and delivery service charges.
- Membership Application
- Applicants must be 18 years old or above.
- Applicant is entitled to register LFMP standard membership for free, by submitting no more than three receipts issued by stores within the past 30 days with a net amount totaling HK$200 or above. Applicant is also entitled to register as LFMP standard member for free with HK$200 or more in a single online transaction at eShop, but applicants must make the application at the stores.
- To ensure member receiving the promotional offers and discounts, members may be requested to supplement or provide La Famille with their complete and accurate personal data, including but not limited to their name, phone number, email address, birthday information and address.
- Failure to provide accurate or complete information after application submission will result in application cancellation without notification.

Once standard member is upgraded to silver or gold membership, La Famille staff will contact applicants to verify their information by phone and/or email, reminders of member benefits and promotions will be sent to the address provided by the member.

After a membership is activated, should a member execute a refund on the receipt of the products or services used for membership application and thereby result in a final transaction amount less than the amount required for membership application, his/her membership will be terminated and canceled without notification.

To the extent permitted by law, TCHKL and La Famille shall not be liable for any claim, demand, liability or action resulting from customer/member’s omission, neglect and/or failure to supply TCHKL with your updated information, or from the accuracy and completeness of those data.
- Membership & Validity
- Standard membership will automatically expire if no purchase has been recorded in the past 12 months; in this case all Upgrade Points and Loyalty Points will be automatically forfeited.
- Silver membership and gold membership are valid for 12 months.
- Silver member and gold member will automatically be awarded 1 Upgrade Point and 1 Loyalty Point for every HK$10 he/she spends. Standard member will only automatically be awarded 1 Upgrade Point, but no Loyalty Point for every HK$10 he/she spends.
- Once standard member accumulates 120 Upgrade Points within 12 consecutive months, his/her membership will be automatically upgraded to silver membership. Once a member accumulates 120 Upgrade Points within the membership effective period, his/her silver membership will be automatically retained and extended for 12 months; vice versa, if a member’s Upgrade Points is less than 120 points, his/her silver membership will be downgraded to standard membership.
- Once silver member accumulates 500 Upgrade Points within 12 months, his/her membership will be automatically upgraded to gold membership. Once a member accumulates 500 Upgrade Points within the membership effective period, his/her gold membership will be automatically retained and extended for 12 months; vice versa, if a member’s Upgrade Points is less than 500 points, his/her gold membership will be downgraded to silver membership.
- All Upgrade Points will automatically reset to zero towards the end of effective period or after upgrade or downgrade or renewal of membership.
- Membership upgrade and downgrade are automatically handled by the system and based on the accumulated Upgrade Points. Members cannot choose to be upgraded or not to be downgraded.
- Membership Usage & Member Discounts
- Any exercise of membership rights and any members-related transactions including but not limited to member discount, Upgrade Points accumulation, Loyalty Points accumulation, member discount redemption, must be made with a membership card for the record purpose.
- Member is eligible for earning points but not qualify for any member discount when he/she logs into his/her membership account to make a purchase on eShop. He/She shall visit any stores and show La Famille staff his/her valid membership card and electronic receipt to redeem Upgrade Point and Loyalty Point within one month from the purchase date.
- A member can only use their designated membership card. The membership card is non-transferrable. If abuse or misuse is found, TCHKL reserves the right to terminate or suspend the membership.
- Member discount is not applicable to purchasing La Famille coupon, discount products, wrapping service charges, delivery service charges, and specified items.
- If a member loses a physical membership card and thus require a replacement, a non-refundable handling fee of HK$100 will be charged. The handling fee will not qualify for any points.
- Purchase of La Famille coupon, wrapping service charges and delivery service charges will not qualify for any points or accumulative spending.
- Members should be responsible for the maintenance and use of their membership cards. TCHKL is not responsible for any loss incurred from stolen or loss of membership card.
- Loyalty Points
- By showing silver and gold membership card, every HK$10 the member spends will be converted to 1 Loyalty Point. The earned Loyalty Points may vary subject to different promotions.
- Loyalty Points will be calculated on 30th JUNE and 31st DECEMBER each year and will be converted to La Famille Prestigious Offer. Prestigious offer will be mailed to member’s address according to the application record within two weeks and it will not be reissued. LFMP points, offers, discounts, and membership only belongs to designed member and cannot be transferred to the others.
- Loyalty Points are valid for 12 months following the effective date of a membership, and Loyalty Points collected after this date will be calculated in calendar year. Loyalty Points accumulated during this calendar year are valid from the effective date until the end of that year. Expired Loyalty Points will be automatically forfeited (exception of upgrade to silver or gold membership). Purchase amount applied to membership application is not applicable to earning Loyalty Points. Points will be earned only during purchases after receiving the membership card.
- The Loyalty Point records of La Famille shall prevail. La Famille will not accept any claim of missing Loyalty Points after transactions, except transactions on eShop (See Clause 3.2).
- Loyalty Points are non-transferable, non-divisible and Loyalty Points stored in different membership card cannot be combined.
- All canceled transactions or refunds will result in the automatic deduction of Loyalty Points obtained from it, including the extra Loyalty Points earned from specific promotions.
- The Lovers Delights awarded to silver and gold member are not applicable to any purchases on Valentine’s Day, Mother’s Day, Christmas Eve, and Christmas Day.
- General
- Reminders of member benefits and promotions will be sent to members via email or SMS. Members should provide valid email address and mobile phone number to avoid missing out on important notices.
- TCHKL is not responsible for any loss of Loyalty Points due to technological or system problems.
- TCHKL has the absolute discretion to refuse and/or revoke the registration of any applicant and to terminate and/or cancel the registration of such applicant for any reason whatsoever. In the event a membership is terminated by TCHKL for any reason(s), related Loyalty Points will also be forfeited immediately.
- If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, such invalidity and unenforceability shall not affect the remainder of the Terms and Conditions, which shall continue in full force and effect.
- All terms and conditions shall be governed by the laws of the Hong Kong SAR and members agree to submit to the exclusive jurisdiction of the courts of the territory.
- TCHKL reserves the right to change the Terms and Conditions without prior notice.
- Should there be any dispute, TCHKL reserves the right of final decision.
- In case of discrepancies between the English and Chinese versions, the English version shall apply and prevail.
- Personal Information Collection Statement
- TCHKL is committed to the protection of privacy in relation to personal information (the “Data”). This Personal Information Collection Statement is to notify you of certain matter on or before collecting Data from you in compliance with the Personal Data (Privacy) Ordinance of the Hong Kong SAR. TCHKL limits the collection and use of the Data to the specific information TCHKL needs to administer the business and provides the highest quality services to you.
- Data collected from a member by TCHKL may be used for administration of membership accounts and records, advertising, marketing, communicating news and information, identification and verification, provision of services, benefits, offers and promotions, administration of database; and other purpose in connection with or incidental to the aforesaid.
- TCHKL may share and/or transfer the Data with TCHKL third party service providers, agents and contractors for the above purposes. TCHKL may also disclose the Data when required by law or court order, or as requested by any government or law enforcement authorities, or in good faith that disclosure is necessary or advisable to protect the rights or properties of TCHKL or other persons.
- The provision of the Data is voluntary. However, if you elect not to provide the Data to TCHKL, TCHKL may not be able to supply you with the relevant information or services or to process your request.
- Applicant has the right to access and correct his/her data. Request of data correction should be addressed in writing to TCHKL.
